NATIONAL RESOURCES. NEW YORK SUPPORT.

TriNet brings New York businesses the resources of a national HR provider:
an all-in-one HR platform, access to large group benefit plans, and dedicated HR professionals who support companies in every US state. From Buffalo to Albany to the Big Apple, New York companies use TriNet to simplify HR and get time back for the work that matters.

What does that look like day to day?
Payroll processing, benefit plan administration, risk mitigation, and real answers to the HR questions that come up as your team grows. And because TriNet's solutions are tailored by industry, the support you get fits the business you actually run.

Operating in New York also means keeping up with state-specific employment-related requirements, and that's where TriNet's HR expertise comes in.
Our team helps New York employers navigate areas like:

Paid sick and safe leave: New York has state-level paid sick and safe leave requirements under the New York State Paid Sick and Safe Leave Ordinance, and some local jurisdictions add their own. TriNet helps you set up and administer time off policies that account for these regulations.
Pay transparency: New York’s Labor Law Section 194-B shapes how employers post roles and discuss compensation. TriNet's HR professionals help you navigate what that means for your hiring.
Minimum wage: New York sets its own minimum wage requirements, and some municipalities set additional local rates. TriNet's payroll platform helps you keep pay rates current across every location you operate in when you process payroll in the TriNet platform.

How TriNet Supports New York Businesses

TriNet PEO

Is a co-employment solution for businesses where TriNet takes on much of the administration for PEO-sponsored benefits, workers’ compensation and payroll tax administration, provides access to large group benefit plans, and includes a $1 million employment practices liability insurance policy.

TriNet HR Plus

An administrative services organization, or ASO delivers HR administration, payroll, and compliance support without the co-employment structure. It's often the right fit for businesses that want expert HR help while remaining the sole employer of record.

What you get with either solution:

New York-specific support.
TriNet also helps New York employers navigate:

Final pay. The New York State Department of Labor sets timing requirements for a departing employee's final paycheck. TriNet helps your team with the offboarding process and final pay with confidence.

Fair hiring. Laws in New York state and New York City limit what questions a business can ask of job candidates. TriNet provides you with tools to streamline applications and best practices for interviews.

Meal and rest breaks. The New York Department of Labor sets meal and rest break requirements for certain employees. TriNet offers best practices to help you with scheduling and meal and break requirements.

State payroll taxes. New York has its own payroll tax registrations and wage base rules. TriNet's payroll services help you administer state payroll tax requirements as you hire and grow.

Frequently Asked Questions

What's the difference between TriNet PEO and TriNet HR Plus?

TriNet offers two ways to outsource HR, and the right fit usually comes down to size, industry, and how much of a bundled solution you need.

  • TriNet PEO is a co-employment solution for businesses with five to 500 employees. TriNet takes on much of the payroll taxes, workers’ compensation and PEO-sponsored benefits administration, provides access to large group benefit plans, and includes a $1 million employment practices liability insurance policy.
  • TriNet HR Plus is an administrative services model (ASO) for businesses from one employee to 500*. You remain the sole employer of record, and TriNet delivers HR administration, payroll, and compliance support.

Either way, you get dedicated HR professionals and the same all-in-one platform.

How much does HR outsourcing cost in New York?

TriNet uses per-employee, per-month admin fee pricing with an itemized breakdown rather than a percentage of payroll, so you can see what you're paying for and costs stay predictable as you grow. Your price depends on:

  • The solution you choose (TriNet PEO or TriNet HR Plus)
  • The services and level of support you add
  • The size of your team

This references only the admin fee. HR Plus may include additional add-on services that you subscribe to, and PEO pricing may include itemized charges such as benefits and workers' compensation. And both may have implementation or setup fees*.

See TriNet PEO pricing and TriNet HR Plus pricing for how each model works, or talk with an expert for a quote based on your team.

Can TriNet help manage New York payroll taxes?

Yes. New York has its own payroll tax registrations, unemployment insurance wage base, and filing requirements. TriNet's payroll services help you:

  • Administer New York payroll tax requirements as you hire
  • Keep up with wage base changes year to year
  • Run multi-state payroll if your team works beyond New York
Does New York require paid sick leave?

To help New York’s lower-wage workers, the state has a paid sick leave law that requires employers with five or more employees or net income of more than $1 million to provide paid sick leave to employees. Employers with fewer than five employees and a net income of $1 million or less are required to provide unpaid sick leave to employees.

In addition to state requirements, New York City also requires most employers to provide unpaid sick leave on top of the paid sick leave.

Does New York have pay transparency requirements?

New York State’s Pay Transparency Law requires private employers with four or more employees to include a range of pay for all advertised job, promotions, and transfer opportunities. The law also prohibits employers from retaliating against employees or applicants who request information on pay ranges and whether a position is commission-based.

TriNet's HR professionals help employers navigate state-specific hiring requirements and considerations, instead of juggling different rules posting by posting. And if you recruit remotely, postings that reach candidates in other states with pay transparency laws may still be subject to those states' requirements.

We run a trucking or logistics business in New York. Which TriNet solution fits?

For field-based businesses like trucking and logistics, TriNet HR Plus is often the strongest fit, with support for the workers’ compensation and scheduling realities that come with the work. You stay the sole employer of record while TriNet handles HR administration, payroll, and compliance support. And if a comprehensive co-employment solution makes sense down the road, TriNet PEO is there to grow into.

Does New York require employers to offer a retirement plan?

New York provides a retirement savings program for private-sector employees who do not have access to a retirement plan at work. Under the New York Secure Choice Savings Program, New York businesses with 10 or more employees at all times during the previous calendar year, and who have been in business for at least two years must facilitate the program if they don’t offer a qualified retirement plan for employees.

Retirement benefits are an important factor in talent acquisition and retention. TriNet can help you access retirement plan offerings for your team that comply with New York Secure Choice requirements and provide strategic support for your benefits program that can compete well, in New York and anywhere else you hire.
