Sometimes you need to reassign duties, shift responsibilities or redefine roles—whether your employee is on board or not. Needs evolve and staying competitive means staying flexible.

In most cases, at-will employers can change job duties. But there are exceptions and smart steps to follow.

When reassigning duties isn’t always straightforward:

• Contract or union considerations—In some cases, employment agreements or collective bargaining arrangements may affect how changes are handled.

• Fairness and consistency— Role changes should be applied thoughtfully and consistently, and not in a way that could be perceived as targeting protected characteristics or protected activity.

• Accommodation considerations— Where applicable, it may be appropriate to consider reasonable accommodations, particularly if job responsibilities are changing.

• Leave considerations — Be mindful of situations where an employee may be on or returning from protected leave, again to avoid the perception of targeting protected activity.

• Pay and overtime rules—Duty changes can affect exempt status or trigger overtime requirements. Some states require as much as 30 days’ advance written notice before pay changes.

• Staffing changes require redistribution
